1. Agreement to Terms
Welcome to Gayborhood! These Terms of Service (“Terms”) are a legally binding agreement between you and Community Social Tech LLC (“Gayborhood,” “we,” “our,” or “us”) governing your access to and use of the Gayborhood mobile application, website, and all related services (collectively, the “Service”).
Gayborhood is a community social platform for gay men. The Service allows you to join tribes, share posts, organize events, discover creators and businesses, and connect with other members of the community. By creating an account, accessing, or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines, all of which are incorporated into these Terms by reference.
If you do not agree to these Terms, do not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of the updated Terms.
2. Eligibility
Gayborhood is an adults-only platform. You must be at least 18 years old to create an account or use the Service. By accessing or using Gayborhood, you represent and warrant that:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding contract with Gayborhood.
- You are not required to register as a sex offender with any state, federal, or local sex offender registry.
- You have not been previously banned or removed from the Service.
- You have not been convicted of, or pled no contest to, a felony or any crime involving violence, threats of violence, sexual misconduct, or sexual abuse.
- You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

If we discover or have reason to believe that you do not meet any of the eligibility requirements above, we reserve the right to immediately suspend or terminate your account without notice or refund.
3. Account Registration & Security
3.1 Account Creation
To use the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information about yourself.
- Maintain and promptly update your account information to keep it accurate and complete.
- Maintain only one account per person. Creating multiple accounts is prohibited.
- Not use another person’s account or share your account credentials with anyone.
3.2 Password & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Choose a strong, unique password and keep it confidential.
- Notify us immediately at support@joingayborhood.com if you suspect any unauthorized access to or use of your account.
- Accept full responsibility for all activity that occurs under your account, whether or not authorized by you.
3.3 Account Termination
You may delete your account at any time through the app settings. We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately.

GAYBORHOOD DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, IDENTITY VERIFICATION CHECKS, OR SEX OFFENDER REGISTRY CHECKS ON ITS USERS. GAYBORHOOD DOES NOT VERIFY THE STATEMENTS, CLAIMS, OR REPRESENTATIONS MADE BY USERS OF THE SERVICE. GAYBORHOOD MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE IDENTITY, CONDUCT, CHARACTER, INTENTIONS, LEGITIMACY, HEALTH STATUS, PHYSICAL CONDITION, OR TRUTHFULNESS OF ANY USER.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. GAYBORHOOD IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, WHETHER ONLINE OR OFFLINE. GAYBORHOOD DOES NOT GUARANTEE THE IDENTITY OF ANY USER YOU COMMUNICATE WITH THROUGH THE SERVICE.
YOU UNDERSTAND AND AGREE THAT GAYBORHOOD DOES NOT SCREEN USERS AND MAKES NO GUARANTEES REGARDING THE SAFETY, ACCURACY, OR APPROPRIATENESS OF ANY USER OR USER CONTENT. USE THE SERVICE AT YOUR OWN RISK.
We strongly recommend that you take precautions when interacting with other community members, especially when meeting in person at events, meetups, or other gatherings:
- Meet in a public place, especially when connecting with someone for the first time.
- Tell a friend or family member about your plans, including where you are going and who you are meeting.
- Arrange your own transportation to and from the meeting.
- Keep your phone charged and accessible.
- Trust your instincts — if something feels off, leave.
- Do not share financial information or send money to other users.
- Report any suspicious, threatening, or harmful behavior to us immediately.
⚠️ LGBTQ+ Safety Notice
Please be aware that Gayborhood is a community platform with location features. In some jurisdictions, being LGBTQ+ may carry legal or personal safety risks. Location data, even when approximate, may allow others to triangulate your general area. We encourage you to review your location and privacy settings carefully, especially if you are in a region where LGBTQ+ identities are criminalized or stigmatized. You can adjust your distance visibility in your profile settings.
5. Community Participation
GAYBORHOOD MAKES NO GUARANTEE REGARDING THE NUMBER OF ACTIVE USERS ON THE SERVICE, THE AVAILABILITY OF COMMUNITY MEMBERS IN YOUR AREA, ANY USER’S DESIRE OR WILLINGNESS TO COMMUNICATE WITH YOU, THE LEVEL OF ENGAGEMENT OR ACTIVITY WITHIN ANY TRIBE, BOARD, OR EVENT, OR YOUR ABILITY TO ACHIEVE ANY PARTICULAR LEVEL OF COMMUNITY INTERACTION, RESPONSE, OR OUTCOME THROUGH USE OF THE SERVICE. GAYBORHOOD IS NOT RESPONSIBLE FOR LOW ENGAGEMENT, LACK OF RESPONSES FROM OTHER MEMBERS, INACTIVE COMMUNITIES, OR UNSATISFACTORY EXPERIENCES.
Gayborhood provides tools for community interaction, including tribes, boards, posts, and events. We do not guarantee any particular level of engagement, response from other members, or community activity in your area. The quality and quantity of community participation depends on the members themselves, and Gayborhood makes no promises about the outcome of any interactions facilitated through the Service.
6. Community Guidelines & Acceptable Use
Gayborhood is built for the gay community to connect, participate, and build community in a safe and respectful environment. Your use of the Service is subject to our Community Guidelines, which are incorporated into these Terms by reference. Violation of the Community Guidelines may result in content removal, account suspension, or permanent termination.
6.1 Prohibited Content
You agree not to post, upload, share, or transmit any content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Contains false information, misinformation, or misrepresents your identity or affiliation.
- Constitutes spam, unsolicited advertising, or commercial promotions.
- Infringes upon the intellectual property, privacy, or other rights of any third party.
- Contains malware, viruses, or any code designed to disrupt or harm the Service.
- Shares the personal information of another person without their consent (doxxing).
- Depicts, promotes, or involves minors in any sexual context whatsoever.
- Contains non-consensual intimate images (“revenge porn”) or threats to distribute such images.
6.2 Prohibited Behavior
You agree not to engage in any of the following conduct:
- Harassing, bullying, stalking, threatening, or intimidating other users.
- Engaging in hate speech, discrimination, or targeting users based on race, ethnicity, religion, disability, gender identity, or any other protected characteristic.
- Attempting to hack, disrupt, reverse-engineer, or compromise the Service or its infrastructure.
- Using bots, scripts, crawlers, scrapers, or other automated tools to access or interact with the Service without our prior written permission.
- Creating multiple accounts or new accounts to evade a ban or suspension.
- Manipulating or gaming the system, including fake engagement, vote manipulation, or artificially boosting visibility.
6.3 Platform-Specific Prohibited Conduct
The following activities are strictly prohibited on Gayborhood:
- Catfishing, fake profiles, or impersonation — Misrepresenting your identity, using someone else’s photos, or pretending to be another person.
- Sex work, escort services, or compensated relationships — Including soliciting or offering “sugar daddy/baby” arrangements, escort services, or any exchange of sexual activity for money, gifts, or other compensation.
- Human trafficking or facilitation thereof — Any activity that facilitates, promotes, or constitutes human trafficking in any form.
- Soliciting money from other users — Requesting financial assistance, donations, loans, or payments from other users.
- Commercial sexual activity — Promoting, advertising, or engaging in commercial sexual services through the platform.
- Drug solicitation or promotion — Soliciting, offering, promoting, or facilitating the sale, purchase, or use of illegal drugs or controlled substances.
- Sextortion or blackmail — Threatening to expose intimate images, conversations, or personal information to coerce, extort, or blackmail another user.
- Sharing non-consensual intimate images — Distributing, threatening to distribute, or soliciting intimate images of any person without their explicit consent.
- Content involving minors — Any content that depicts, references, or involves minors in a sexual context is strictly prohibited and will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement.

We take violations seriously. Depending on the severity, violations may result in a warning, temporary suspension, permanent ban, and/or referral to law enforcement. For full details, see our Community Guidelines.
7. User Content
7.1 Your Content
You retain ownership of all content you create, upload, post, or otherwise make available through the Service (“User Content”), including but not limited to profile information, photos, messages, posts, and comments.
7.2 License Grant
By posting or sharing User Content on or through the Service, you grant Gayborhood a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual (or for the duration of any copyright or other rights in such content) license to use, host, store, display, reproduce, modify, adapt, publish, translate, distribute, and create derivative works from your User Content, in whole or in part, in any media formats and through any media channels now known or hereafter developed, for the purposes of operating, providing, promoting, and improving the Service.
This license continues even if you stop using the Service, to the extent your User Content has been shared with others, incorporated into the Service, or is reasonably necessary for Gayborhood to continue providing the Service. You may request deletion of your User Content by deleting your account or specific content, and we will make commercially reasonable efforts to remove it, subject to our data retention practices described in our Privacy Policy.
7.3 Content Moderation
We reserve the right, but have no obligation, to monitor, review, edit, remove, or disable access to any User Content at our sole discretion, for any reason or no reason, including but not limited to content that we believe violates these Terms, our Community Guidelines, or applicable law. We are not responsible for any failure or delay in removing User Content.
7.4 Content Responsibility
You are solely responsible for your User Content and the consequences of posting or publishing it. Gayborhood does not endorse any User Content and expressly disclaims any and all liability in connection with User Content. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to post your User Content and to grant the license above.
7.5 Copyright & DMCA
We respect intellectual property rights and expect our users to do the same. If you believe that any User Content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent at legal@joingayborhood.com with “DMCA Notice” in the subject line. Your notice must include:
- A description of the copyrighted work you claim has been infringed.
- Identification of the material that is claimed to be infringing and its location on the Service.
- Your contact information (name, address, telephone number, and email address).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
8. AI & Automated Features
Gayborhood may use artificial intelligence (“AI”) and machine learning (“ML”) technologies to operate and improve the Service, including but not limited to:
- Content moderation — Automated detection and review of content that may violate our Terms or Community Guidelines.
- Content and community recommendations — Suggesting tribes, posts, events, and community members based on your interests and activity.
- Service improvements — Analyzing usage patterns to improve features, user experience, and safety.
AI-generated recommendations and moderation decisions may not always be accurate. We use a combination of automated tools and human review to ensure quality and fairness.
8.1 Restrictions on Data Use
You agree not to:
- Use any data obtained from Gayborhood to train, develop, improve, or fine-tune any third-party AI or ML models, algorithms, or systems.
- Scrape, crawl, spider, harvest, or use any automated means to collect data, content, or information from the Service.
- Use the Service or any data from the Service for any commercial AI/ML purpose without our prior written consent.
9. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect your personal information when you use the Service. By using Gayborhood, you acknowledge that you have read and agree to our Privacy Policy, which is incorporated into these Terms by reference.
10. Push Notifications
By using the Service, you may receive push notifications from Gayborhood, including but not limited to messages, tribe activity, post replies, event updates, community activity, promotional offers, and service updates. Push notifications are an important part of the Gayborhood experience and help keep you informed about activity relevant to you.
You can disable push notifications at any time through your device settings or within the Gayborhood app settings. Please note that disabling notifications may affect your experience and your ability to receive important communications about your account or safety.
11. Disclaimers & Limitations of Liability
11.1 “As Is” Disclaimer
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. GAYBORHOOD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
GAYBORHOOD DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE SERVICE OR ANY CONTENT WILL BE ACCURATE, RELIABLE, OR COMPLETE; (D) THE SERVICE WILL BE COMPATIBLE WITH ALL DEVICES OR OPERATING SYSTEMS; OR (E) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM GAYBORHOOD OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAYBORHOOD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (E) ANY IN-PERSON MEETINGS OR INTERACTIONS WITH OTHER USERS, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF GAYBORHOOD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL GAYBORHOOD’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO GAYBORHOOD IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
11.3 Specific Exclusions
Without limiting the foregoing, Gayborhood is not responsible or liable for:
- The actions, conduct, or behavior of any user, whether online or offline.
- Service interruptions, outages, or downtime, whether planned or unplanned.
- Loss, corruption, or unauthorized access to your data or content.
- Content provided by third parties, including other users, advertisers, or linked websites.
- Any harm, injury, or damage resulting from in-person meetings or interactions with other users.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, the above limitations shall apply to the fullest extent permitted by applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Gayborhood, Community Social Tech LLC, and their respective affiliates, officers, directors, employees, agents, partners, and licensors (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:
- Your access to or use of the Service.
- Your violation of these Terms, our Community Guidelines, or our Privacy Policy.
- Your User Content, including any claim that your User Content infringes or violates the rights of any third party.
- Your violation of any applicable law, rule, regulation, or the rights of any third party.
- Any claim or dispute arising from your in-person meetings or interactions with other users of the Service.
- Any misrepresentation made by you.
Gayborhood reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You will not settle any claim without Gayborhood’s prior written consent.
13. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
13.1 Informal Resolution First
Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at legal@joingayborhood.com. You must provide a written description of the dispute, including your name, account information, and the relief you are seeking. We will attempt to resolve the dispute within sixty (60) days of receiving your notice. If the dispute is not resolved within this 60-day period, either party may proceed to binding arbitration as described below.
13.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the formation, interpretation, breach, or termination of these Terms) shall be finally resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect, except as modified by this section. The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND GAYBORHOOD AGREE THAT EACH PARTY MAY ONLY BRING CLAIMS AGAINST THE OTHER IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Gayborhood agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.
13.4 Jury Trial Waiver
YOU AND GAYBORHOOD HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
13.5 Mass Arbitration Procedures
If twenty-five (25) or more similar arbitration demands are filed against Gayborhood within a 60-day period, the parties agree that the AAA shall group the demands into batches of no more than fifty (50) claims per batch (plus any remainder batch). Each batch shall be treated as a single consolidated arbitration proceeding. The arbitrator for each batch shall be selected in accordance with AAA rules. Only one batch may proceed at a time, and the resolution of each batch shall inform the resolution of subsequent batches. This provision is designed to ensure efficient and fair resolution of mass claims.
13.6 Small Claims Court Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdiction of such court. Additionally, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
13.7 Arbitration Opt-Out
⚠️ Important — Your Right to Opt Out
You have the right to opt out of binding arbitration within thirty (30) days of the date you first use the Service or accept these Terms (whichever is earlier). To opt out, send an email to legal@joingayborhood.com with the subject line “Arbitration Opt-Out” and include your full name, email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement. If you opt out, you and Gayborhood may litigate disputes in court, subject to the governing law and venue provisions below. Opting out of arbitration will not affect any other provision of these Terms.
13.8 Governing Law & Venue
These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. For any dispute not subject to arbitration, or if you have validly opted out of arbitration, you and Gayborhood agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
14. Third-Party App Stores
If you download or access the Service through a third-party app store (such as the Apple App Store or Google Play Store), you acknowledge and agree that:
- These Terms are between you and Gayborhood (Community Social Tech LLC), not with Apple Inc., Google LLC, or any other app store provider (each, an “App Store Provider”).
- The App Store Provider has no obligation to provide any maintenance, support, or update services for the Service.
- Gayborhood, not the App Store Provider, is solely responsible for the Service, including any product warranties (whether express or implied by law), product liability claims, and any claim that the Service fails to conform to applicable legal or regulatory requirements.
- In the event of any third-party claim that the Service or your use of the Service infringes a third party’s intellectual property rights, Gayborhood, not the App Store Provider, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- The App Store Provider and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, the App Store Provider will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- You must also comply with all applicable third-party terms of service when using the Service (e.g., the App Store Provider’s terms).
15. Termination
15.1 Termination by Gayborhood
We may suspend, restrict, or terminate your account and access to the Service at any time, with or without cause and with or without notice, at our sole discretion, including but not limited to the following reasons:
- Violation of these Terms, our Community Guidelines, or our Privacy Policy.
- Fraudulent, illegal, or harmful activity.
- Conduct that harms other users, third parties, or the Service.
- Extended periods of inactivity.
- Requests by law enforcement or government agencies.
- Discontinuation or material modification of the Service.
15.2 Termination by You
You may delete your account at any time through the app settings. Upon deletion, your profile will be removed from the Service. Please note that some information may be retained in accordance with our Privacy Policy and applicable law.
15.3 Effect of Termination
Upon termination of your account, your right to use the Service immediately ceases. The following sections shall survive termination of these Terms: Safety Disclaimer & No Background Checks (Section 4), Community Participation (Section 5), User Content (Section 7), Disclaimers & Limitations of Liability (Section 11), Indemnification (Section 12), Dispute Resolution & Arbitration (Section 13), and General Provisions (Section 16), as well as any other provisions that by their nature should survive.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, Community Guidelines, and any other policies or agreements referenced herein, constitute the entire agreement between you and Gayborhood regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
16.2 Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
16.3 No Waiver
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Gayborhood.
16.4 Assignment
You may not assign, delegate, or transfer these Terms or any of your rights or obligations hereunder without our prior written consent. Gayborhood may assign, delegate, or transfer these Terms and any rights and obligations hereunder without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
16.5 Force Majeure
